You have the right to take photos of police officers on duty and as a photographer you have the right to publish your photos on the internet. So -in principle- you have the right to publish photos of police officers on the internet. However, police officers are individuals with a right of privacy and a right to their image. … If you violate the copyright of the chef. A recipe is no more than a list of ingredients, and as such not copyright protected. Hence, it is perfectly legal to copy a recipe from a book and cook it, tweet it, share it. AFP and Getty Images need to pay 1.2 million in damages to photographer Daniel Morel. They took 8 of his Haiti earthquake pictures from Twitter and distributed them without his permission. But according to the American judge, the fact that pictures are published on Twitter doesn't mean that they may be reused commercially. Daniel Morel is a professional photographer who took photos from the Haitian Earthquake in 2010. He posted 13 of his photos via TwitPic (a well known Twitter photo service). Another Twitter user retweeted them and they spread quickly over the internet. Getty…continue reading →

Free images: Is giving credit to the author required?

Free icons and images as long as you give proper credit to the author. We increasingly see this business model. You can use the imagery for free, as long as you name the author with his work. But do you really need to do that? The answer is affirmative. The attribution requirement as found in the GNU Free Documentation License and Creative Commons licenses, is a valid license condition. If you don’t respect the attribution clause, you commit copyright infringement, in the same way as when you don’t pay the license fee. If…continue reading →

Are birds copyright protected?

Are birds copyright protected?

Pos Malaysia, the Malaysian post authority issued six birdlife stamps as part of a Visit Malaysia Year 2014 stamp collection. Nothing special, if the designers hadn’t just grabbed the bird-pictures from the internet. But they didn't use the photos as a whole. They cut out the birds and photoshopped them into a new background. This brings us to an interesting question. Is this copyright infringement? Animals, just like other things of nature aren't copyright protected. So birds aren't copyright protected and nobody can claim rights on them. That's a fact. Vatican stops exhibition with photos of gay couples kissing in churches

Photographer Gonzalo Orquin made pictures of same-sex couples kissing in churches, and intended to show them in his exhibition "Trialogo". But apparently the exhibition was stopped by the Vatican. As a lawyer I was immediately intrigued. What legal basis can the Vatican invoke to stop such exhibition? Well, apparently, the Vatican found its legal basis in the Italian constitution. Vicariate spokesman Claudio Tanturri told The Local the following: “Italian constitutional law safeguards an individual’s religious feeling and the function of places of worship. Therefore photos that are not suitable and do not conform to the spirituality…continue reading →
